The Office of Workers’ Compensation within the Delaware Department of Labor’s Division of Industrial Affairs administers and enforces state laws governing workplace injuries and illnesses. We facilitate the process that enables injured workers to receive all available benefits while supporting employer compliance by promoting safe, healthy workplaces across Delaware.

Stay Compliant

Risk of Non-Compliance

  • Employers are required by law to carry workers’ compensation insurance for their employees.
  • Failing to do so can lead to fines, stop-work orders, and potential legal action.
  • Without valid insurance, employers are personally responsible for all costs related to a workplace injury or illness, including medical bills and lost wages.
  • Keeping coverage current protects both your employees and your business.

Delaware Workers’ Compensation Requirements

All Delaware employers with employees working in the state must carry a Delaware Workers’ Compensation policy.
Employers must provide one of the following:
  • A Delaware workers’ compensation policy covering all work performed in Delaware, or
  • An out-of-state policy with a written endorsement that specifically includes Delaware coverage.
  • Delaware must be listed in Section 3A of your policy.
  • “All states” coverage does not meet Delaware requirements.
  • Certificates of Liability are not accepted as proof of coverage.
  • Submit a copy of the Declaration Page or the full workers’ compensation policy as valid proof.
Your insurance carrier must:
  • Be licensed in the State of Delaware
  • Be qualified by the Delaware Office of Workers’ Compensation
  • Be a member of the Delaware Compensation Rating Bureau
