Employer Insurance Requirements
Understand Delaware's mandatory workers' compensation insurance requirements, verify coverage obligations for your business, and maintain compliance with state law.
First Report of Injury
File a First Report of Injury and submit to OWC. Employer must submit this report within ten days of notification of the injury per the Workers' Compensation Act.

Delaware Workers’ Compensation Requirements
All employers with employees working in the state must carry a Delaware Workers’ Compensation policy.
- A Delaware workers’ compensation policy covering all work performed in Delaware, or
- An out-of-state policy with a written endorsement that specifically includes Delaware coverage.
- Delaware must be listed in Section 3A of your policy.
- “All other states” coverage does not meet Delaware requirements.
- Certificates of Liability are not accepted as proof of coverage.
- Submit a copy of the Declaration Page or the full workers’ compensation policy as valid proof.
- Have a Certificate of Authority issued from the Department of Insurance
- Be qualified by the Delaware Office of Workers’ Compensation
- Be a member of the Delaware Compensation Rating Bureau
