What does “presumption of reasonableness” mean?
When a certified provider treats an injured worker within the Delaware treatment guidelines, the law presumes the care is reasonable and necessary. This makes it easier for providers to deliver care without delays and helps carriers approve treatment more quickly. To challenge treatment that falls within the guidelines, a carrier must provide strong evidence that the care is not appropriate.
