What are the penalties for misclassifying workers?

Penalties can include monetary fines, stop-work orders, and repayment of unpaid wages or benefits. Businesses that violate the law may also be placed on the state’s public Workplace Fraud Violators List for three years. Repeated or intentional violations can lead to higher penalties and additional enforcement actions.

 

Misclassification can also affect a contractor's eligibility for registration and public work.
