Can criminal charges result from noncompliance with Delaware Workers’ Compensation laws?

Yes. Employers who knowingly and repeatedly violate Workers’ Compensation insurance requirements may face criminal penalties in addition to civil fines. Criminal charges are typically reserved for serious or intentional noncompliance, such as willful refusal to obtain insurance or falsifying required records.
