Are out-of-state employers required to carry Delaware Workers’ Compensation insurance?

Yes. If an out-of-state employer has employees working in Delaware, they must secure Workers’ Compensation coverage that specifically applies to Delaware. This can be done through a Delaware policy, a Delaware rider on an out-of-state policy, or approved self-insurance. Simply being insured in another state is not enough if the work is performed in Delaware.
