When am I entitled to overtime pay?

Overtime pay is generally required when a non-exempt employee works more than 40 hours in a workweek. Overtime must be paid at least 1.5 times the regular rate of pay.

Delaware does not have its own general overtime statute. Overtime rules come from federal law (Fair Labor Standards Act), but Delaware Wage & Hour may assist with complaints involving unpaid overtime.
