Are rest breaks required in Delaware?

Delaware law does not require employers to provide short rest breaks (such as 10- or 15-minute breaks) for adult employees. However, if an employer chooses to provide short breaks, they may have pay obligations under applicable wage laws.

Meal break requirements are separate and must be followed when applicable.

Law Reference: No Delaware statute requiring adult rest breaks; meal break governed by Title 19 §707
